These Terms of Sale apply to purchases made through the Cindy's Classroom Games website. They govern the sale and delivery of our digital educational products.

By placing an order, you agree to these Terms of Sale together with our Terms of Use, Refund Policy, and Privacy Policy.

1. Seller

Cindy's Classroom Games provides digital educational products through this website.

2. Products

Cindy's Classroom Games sells digital educational resources, including games, activities and other teaching materials.

Products may be supplied in formats including, but not limited to:

  • Microsoft PowerPoint
  • Google Slides
  • Google Forms
  • PDF
  • Other digital formats or online resources specified on the applicable product page

Unless expressly stated otherwise on the product page, products sold through this website are digital products and no physical item will be shipped.

3. Product Information

We make reasonable efforts to describe our products accurately and provide customers with sufficient information to make an informed purchasing decision.

Product descriptions may identify matters such as the subject, topic, educational level, product type, file format, software or account requirements, and intended use.

Minor differences in appearance may occur depending on the customer's device, operating system, software version, browser, display settings, or other technical factors.

4. Customer Responsibility for Compatibility

Before purchasing, customers are responsible for reviewing the product description and determining whether the specified product format is suitable for their needs and compatible with the software, accounts, devices, and services available to them.

For example, a product identified as a Microsoft PowerPoint product may require compatible PowerPoint software; a Google Slides or Google Forms product may require an appropriate Google account and access to the relevant Google service; and a PDF product requires software or a device capable of opening PDF files.

Customers should not assume that a product will be available in a different format unless the product description expressly states this.

5. Prices

The price applicable to a product is the price displayed on the website at the time the order is placed, subject to correction of obvious errors.

Prices, promotions and product availability may change without notice before an order is completed.

Any taxes that are required to be charged will be handled in accordance with applicable law and, where appropriate, displayed during the purchasing process.

6. Orders

Customers select the products they wish to purchase and complete the checkout process provided on the website.

Before completing an order, customers are responsible for checking the products selected and the information provided.

An order is considered completed when the checkout process has been successfully completed and payment has been accepted, subject to any fraud, payment, or security checks.

An order confirmation will normally be sent electronically to the email address provided by the customer.

We reserve the right to refuse or cancel an order where reasonably necessary, including in cases of suspected fraud, unauthorized payment, obvious pricing or technical errors, or misuse of the website.

If we cancel an order after payment has been collected, the applicable amount will be refunded.

Payments may be processed by Shopify and/or third-party payment providers. The availability of particular payment methods may vary.

The customer is responsible for ensuring that they are authorized to use the selected payment method and that the information supplied during payment is accurate.

8. Digital Delivery

Digital products are supplied electronically following successful completion of the purchase.

Depending on the product, delivery may take the form of a downloadable file, download link, access link, online resource, or another digital delivery method described on the product page.

No physical delivery should be expected unless expressly stated otherwise.

Customers are responsible for providing an accurate email address and maintaining access to the email address and customer account associated with their purchase.

Digital products and downloadable files may be updated, corrected, revised, replaced, or withdrawn after purchase. Where continued download or account access is provided, the version subsequently available to the customer may therefore differ from the version originally supplied.

Where reasonably necessary, we reserve the right to replace a purchased product with an updated, revised, successor, or substantially equivalent product or resource. This may include circumstances where the original product is discontinued, withdrawn, subject to a legal or intellectual property concern, affected by a technical issue, or otherwise no longer appropriate for continued distribution.

Where a replacement is made, we will make reasonable efforts to provide a product or resource with substantially similar educational purpose, subject matter, or functionality where practicable.

9. Digital Content and Right of Withdrawal

Digital products may be made available for download or access immediately following purchase.

Where applicable law provides consumers with a right to withdraw from a distance contract, special rules may apply to digital content supplied before the normal withdrawal period has expired.

Where required by applicable law, immediate access to digital content may therefore be provided only after the customer has expressly requested immediate performance and acknowledged that this may result in the loss of a statutory right of withdrawal once supply of the digital content begins.

Nothing in these Terms removes or limits a mandatory right of withdrawal or other consumer right that cannot legally be excluded.

10. Refunds

Due to the nature of digital products, purchases are generally final once digital content has been supplied or made available, subject to applicable consumer law.

Our rules regarding refunds, defective products, duplicate purchases, changes of mind, and product compatibility are explained in our Refund Policy.

Customers wishing to request a refund should use the Contact form on our website.

Submitting a request does not guarantee that a refund will be approved.

11. Technical Problems

If a purchased product is inaccessible, corrupted, defective, or otherwise affected by a technical problem, please contact us through the Technical Support form.

Where reasonably possible, we may attempt to resolve the issue by providing technical assistance, replacement access, a replacement or corrected file, an updated or substantially equivalent product or resource, or another appropriate solution.

Technical support does not include providing software, subscriptions, accounts, hardware, or other third-party products required to use a product.

12. Errors, Updates, Withdrawals and Replacements

We make reasonable efforts to ensure that our educational products are accurate and functional.

If an error or other issue is identified, we may correct, revise, update, replace, or withdraw the affected product.

We may also discontinue or withdraw a product where reasonably necessary, including because of changes in educational content, technical requirements, third-party services, legal requirements, intellectual property concerns, licensing issues, or other circumstances affecting our ability or decision to continue distributing the original product.

Where a customer previously purchased a product that is subsequently corrected, updated, replaced, discontinued, or withdrawn, we may provide access to a corrected or updated version, a successor product, or another substantially equivalent educational resource in place of the original product.

A replacement product or resource does not need to be identical to the original product, provided that we make reasonable efforts, where practicable, to provide a replacement with substantially similar educational purpose, subject matter, or functionality.

Nothing in this section limits any mandatory remedy, refund right, conformity requirement, or other consumer right that applies under applicable law.

13. License and Permitted Use

Purchasing a digital product grants the customer a license to use that product; ownership of the underlying intellectual property is not transferred.

Unless expressly stated otherwise, products are licensed for the purchaser's own personal or educational use, including normal classroom use with students personally taught by the purchaser.

Products may not be resold, redistributed, shared with unlicensed users, uploaded for public access, or otherwise commercially exploited except where expressly authorized.

14. Customer Accounts

Where an account is used to purchase or access products, customers are responsible for maintaining the confidentiality and security of their account credentials.

Customers must not provide account access to another person for the purpose of circumventing product licensing, purchasing, or access restrictions.

15. Third-Party Platforms and Software

Some products may be designed for use with third-party platforms or software such as Microsoft PowerPoint or Google services.

References to third-party products, services, or trademarks are used to identify compatibility or intended use and do not necessarily imply sponsorship or endorsement.

Third-party services are operated independently and may change their features, availability, compatibility, pricing, or terms.

We are not responsible for changes made by third-party providers that are outside our control, subject to any rights customers may have under applicable law.

16. Liability

We provide educational products for teaching and learning purposes but do not guarantee any particular educational, academic, examination, or other outcome.

To the maximum extent permitted by applicable law, we are not responsible for losses caused by circumstances outside our reasonable control or by a customer's failure to comply with clearly stated product requirements.

Nothing in these Terms excludes or limits liability or consumer rights where doing so would be prohibited by law.

17. Personal Information

Personal information associated with orders and customer accounts is processed in accordance with our Privacy Policy.

18. Changes to These Terms

We may update these Terms of Sale from time to time.

The Terms applicable to a particular purchase will generally be those in effect when the customer places the order, except where a change is required by law or otherwise lawfully applies.

The current version will be published on our website together with its most recent update date.

19. Applicable Law and Consumer Rights

These Terms are governed by applicable law.

Nothing in these Terms deprives a consumer of mandatory protections provided by the law that applies to them, including any protections that cannot be varied by contract.
